Terms and Conditions

THESE TERMS AND CONDITIONS APPLY TO THE CONTRACT BETWEEN NAJI REALTIES, REGISTERED AT 14 ROYAL PALM DRIVE, OSBORNE PHASE II, IKOYI, LAGOS HEREIN REFERRED TO AS THE ‘OWNER’ AND YOU REFERRED TO AS ‘GUESTS’ FOR THE HIRE OF APARTMENT ACCOMMODATION.

IT IS AGREED AS FOLLOWS:

  1. THE ACCOMMODATION
  • For the rental duration, we shall supply and lease the apartment at the agreed price and in compliance with the terms of this Agreement.
  • Furthermore, we provide: (a) regular maintenance services as needed to keep the apartment in good working order; (b) cleaning and fresh bed linen as stated in the booking; and (c) furniture and appliances.
  • We grant you the right to use the apartment for the rental duration (together with us and all the others approved by us). This right shall terminate at the completion of the Lease Contract (subject to any earlier termination pursuant to this Agreement) or at the expiry of any extension of the Lease Period.
  • You accept that this Arrangement does not give rise to a guaranteed short hold rent or lease.
  1. BOOKING AND PAYMENT
  • Bookings and payments purchase the right to be a guest of Naji Realties for the agreed number of nights listed in the booking confirmation email and do not exceed the agreed dates.

IMPORTANT NOTE: In the booking confirmation, no tenancy rights are agreed upon or implied or planned. In any way, the booking confirmation is not a tenancy agreement.

  • You must provide us with ample details at the outset to complete a reservation.
  • Prior to receipt of apartment keys, visitors will be expected to recognize the apartment rules and to sign an agreement.
  • Identification will be required. For travelers outside Nigeria, this must be an International Passport. For Nigerian residents, this should be one form of photographic identification (which must be a national ID card, driver’s license, voting card or Corporate ID).
  • Guests are not entitled to invite non-guests to stay in an apartment at Naji Realties. Additional guests will be registered and there will be an additional fee paid per guest per night.
  • Leaving non-registered guests alone in the apartment is prohibited. Non-registered guests will be asked to leave if non-registered guests are present.
  • Prior to booking, any special requests relating to the renting of an apartment should be brought to our notice. We will take fair efforts to satisfy any special requests and extra costs may be incurred for specific requests.
  • Until full payment with the appropriate guest registration information is made, there is no verified reservation. The full balance must be charged or in cash at check-in for bookings less than 7 days before arrival. We can terminate this Agreement immediately upon notification to you, if you default on payment.
  • Unless otherwise agreed in writing, for every full or part day the Apartment has not been returned beyond the agreed date of return, we may charge a full day’s hire at current hire rates for each part or full day the Apartment is not returned to us. Payment of any such further charges shall be made upon demand and you authorize us to take such further charges from any credit or debit card used to make the Booking.
  • Naji Realties reserves the right, without giving a reason, to deny any reservation or to cancel, change or modify the arrangements made by the guest. We will attempt to arrange alternative accommodation in the unlikely event that the accommodation fails to be available for the time of booking, and if this is not satisfactory to the guest, all monies charged will be refunded to the guest.
  1. CANCELLATIONS
  • We must be notified of any booking cancellations in writing via email.
  • If you send notice of termination at least 60 days before the start of the lease term, a 50 percent cancellation fee will be paid.
  • If you offer notice of cancellation for less than 60 days, we will charge a cancellation fee equal to the agreed amount.
  • If you do not arrive and sign in as decided at the apartment, we will apply the cancellation fee referred to in this provision.
  • Payments made for discounted bookings are non-refundable, Naji Realties decides to make an exception in writing at the time.
  1. ARRIVAL AND DEPARTURE
  • Unless otherwise agreed with us, you can check-in at the apartment from 12:00 pm on the first day of the Hire Period.
  • On the last day of the rental contract, you must check out the apartment by 12:00pm. Failure to do so could lead to additional charges.
  • Subject to availability, earlier check-in or later check-out and may incur additional charges.
  • Before the start of the rental period, we will provide you with more detailed instructions about check-in (including key collection); and check-out instructions (including key return) upon your arrival at the apartment.
  1. YOUR OBLIGATIONS

During the Hire Time, you must:

  • Use the apartment as residential private accommodation only;
  • Ensure that the number of people using the apartment does not exceed the maximum number of people notified to you upon booking.
  • Keep the apartment in good repair, condition and in a clean and tidy state at all times;
  • Not to repair or attempt to repair or conduct work on the apartment or to permit any third party to do so unless advised in writing by us;
  • inform us of any harm to the apartment or its contents immediately upon causing or becoming aware of it;
  • Unless otherwise decided, do not allow any pets or animals to enter the apartment.
  • In the apartment and in common areas or balconies or roof terraces, no smoking;
  • Do not cause a disturbance or damage to residents of surrounding premises (or allow someone into the apartment who causes it)
  • not to act in an aggressive or threatening way towards our employees;
  • not without our prior permission to remove any furniture and appliances or other objects from the apartment;
  • return the apartment to us in line with the terms of this Agreement and in good repair, condition and in a clean and tidy status at the completion of the lease period or upon the earlier termination of this Agreement.
  • Indemnify us and hold us indemnified on request for any claims, liabilities, losses, costs and expenses (including legal fees) sustained or suffered by us in connection with or in connection with any use or misuse of the Apartment (except for personal injury or death caused by our negligence) in connection with this Agreement or in connection with any use or misuse of the Apartment.
  • Do not, without mutual consent, use apartments for parties or other non-residential activities. At the discretion of Naji Realties, payment for losses/damages can be paid.
  • The owner(s) or the agent of the owner(s) should be informed at the earliest opportunity of any damage to the apartment or its contents, or any malfunction of the equipment given or any loss of the keys/electronic fobs/garage entry unit.
  • You consent to grant us or our designated representatives permission to access the apartment to inspect the state of the apartment at any appropriate time.
  • If you fail to meet any of your obligations under this Agreement, we may terminate this Agreement without reimbursement immediately upon notice to you.
  1. SECURITY DEPOSIT
  • Please make sure the apartment is inspected immediately upon check-in and delivery. Unless otherwise told within two hours of check-in and arrival, we would be entitled to presume that you have completely agreed that the state of the apartment is in compliance with the Inventory and Condition Report.
  • A security deposit may be taken at or prior to arrival and check-in at the apartment to cover damage or default in obligations. When the apartment is returned to us in compliance with the terms of this Agreement, any security deposit paid will be returned in full (or any payment authorization cancelled) to you. Where you are liable under clause for loss or damage, we may withhold such loss or damage.
  • The possibility of harm to the apartment and furniture and equipment will be passed on to you upon check-in and delivery and will remain with you until the expiry of the lease period or the return of the apartment to us in compliance with the terms of this Agreement. You shall compensate us for any loss or harm to or to the apartment that occurs during or results from the lease term and any reasonable losses.
  1. EXTENSIONS AND CHANGES
  • Should you wish to extend the Hire Period a request must be submitted to us and we may at our discretion and subject to availability, grant such request.
  • In the case of an extension you agree to make all additional payments.
  1. INSURANCE AND LIABILITY
  • Possessions: The owner(s) is not responsible for theft or damage to any property left in the apartment or in the car park of Naji Realties. Guests must ensure that when they are out, apartment doors and windows are locked, and it is recommended that the entrance door be locked when in residence. Guests are responsible for the security of any vehicles where park within the premises.
  • The apartment has been chosen to be suitable and sufficient for your needs. We make no promise or representation as to the suitability or fitness of the apartment for the purpose and exclude all liability in this regard. You further agree that while material on the website is published in good faith, including any photos, sketches or plans of the apartment, we do not warrant that any content is published in good faith, we do not warrant that any of the content accurately or completely describes the Apartment. Actual Apartment size, design, fixtures, furnishings and facilities may vary.
  1. COMPLAINTS
  • We strive to provide quality services. If, however, you wish to raise something you are not happy with, please call Client Support by telephoning +23409053813763, 
    or emailing info@najirealties.ng. In order to fix any issues that arise, we will strive to do our best.
  1. TERMINATION

We may terminate this Agreement immediately by giving written notice to you if:

  • You commit some material or recurring violation of this Agreement and, if the breach is capable of remedy, you fail to remedy it within 24 hours of being informed of the breach. Note that upon termination, there will be no refund.
  • Any act or omission which, in our view, may jeopardize our rights in the apartment

Upon expiry or termination of this Agreement for any reason whatsoever you shall:

  • Pay to us any Agreed Price in arrears and all other moneys due under this Agreement;
  • Return the Apartment to us in good repair, condition and in a clean and tidy state; and
  • Indemnify us against all reasonable costs incurred by us as a result of any failure to comply with such return conditions
  • We reserve the right to recover the Apartment from you if you default in surrendering the Apartment back to us. You shall indemnify us and keep us indemnified against any and all costs, losses and expenses (including legal expenses) incurred in retaking possession of the Apartment.

GENERAL

  • We operate a policy of continuous improvement and reserve the right to change/move furniture in all apartments. As such, whilst we make every effort to ensure accuracy and currency of all photographs, changes to furnishings may not be reflected in photographs displayed on this website.
  • An omission by a party to exercise, or a delay in exercising, any right or remedy under this Agreement shall not constitute a waiver of the right or remedy or a waiver of any other rights or remedies which that party may otherwise have and no single or partial exercise of any right or remedy under this Agreement shall prevent any further exercise of the right or remedy or the exercise of any other right or remedy. Any waiver of a breach of any of the terms of this Agreement or of any default under this Agreement shall not be deemed a waiver of any subsequent breach or default and shall not affect the other terms of this Agreement.
  • Entire Agreement. Each party acknowledges that this Agreement constitutes the entire agreement and understanding between the parties with respect to the subject matter of this Agreement and supersedes all prior discussions, understandings and agreement between the parties and their agents except for such variations as shall be agreed in writing by us and you. Each party also agrees that in entering into this Agreement, it is not relying on any statements, warranties or representations given or made (whether negligently or innocently and whether express or implied), or any acts or omissions by or on the part of any other party in relation to the subject matter of this Agreement (except those expressly set out in this Agreement) and it undertakes not to enforce or pursue any rights or remedies with respect to such subject matter otherwise than under this Agreement and hereby waives and releases the other party in respect thereof absolutely.
  • This Agreement is personal to the parties. We may assign our right title benefit and interest in and to this Agreement without your consent. You may not assign your right title benefit and interest in and to this Agreement.
  • Any notice or demand to be given under this Agreement by either party to the other shall be in writing (or by email) and shall be deemed to have been properly served if left at or sent by first class pre-paid post to the current number for that party’s address as mentioned in this Agreement or last known to the party sending the notice or demand, and if so posted shall be deemed to have been received on the day following the date of posting and if sent by email shall be deemed to have been received one hour after the time of transmission or, if transmitted out of normal business hours, one hour after the subsequent opening of business.
